In Australia, divorce may only be granted if the Court is satisfied that the parties in the marriage have separated for at least a year (*although some exceptions apply) and that the parties have no prospect of reconciliation. Parties who cannot come to an agreement in respect of their property division and custody matter should also seek judgment from the Court accordingly. If the parties have come to an agreement in respect of the above, the Family Law Act 1975 requires that the parties must obtain independent legal advice before they enter into a binding agreement.
